Nd\u00ebrkoh\u00eb, ai parashikon edhe nj\u00eb amnisti t\u00eb pjesshme 30-ditore p\u00ebr ata q\u00eb kan\u00eb shkelur afatet e regjistrimit t\u00eb pron\u00ebs n\u00eb Hipotek\u00eb, t\u00eb cil\u00ebt gjat\u00eb asajperiudhe nuk do t\u00eb ken\u00eb detyrimin p\u00ebr t\u00eb paguar kamat\u00ebvones\u00ebn.<\/p>\n<p>N\u00eb nj\u00eb prononcim publik dje, drejtori i ALUIZNI-t Artan Lame njoftoi se para pak dit\u00ebsh u botua n\u00eb fletoren zyrtare Ligji \u201c<em>P\u00ebr Kadastr\u00ebn n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb\u201d. Ky botim erdhi pas miratimit n\u00eb heshtje t\u00eb k\u00ebtij ligji nga ana e Presidentit t\u00eb Republik\u00ebs. Sipas Lames, sot Shqip\u00ebria ka nj\u00eb ligj q\u00eb hedh bazat juridike t\u00eb kadastr\u00ebs moderne t\u00eb saj.<\/em><\/p>\n<p><em>P\u00ebrtej faktit se disa an\u00eb pozitive t\u00eb k\u00ebsaj nisme ligjore jan\u00eb shmangia e burokracive, shkrirja e disa institucioneve q\u00eb merren me pron\u00ebsin\u00eb n\u00eb nj\u00eb t\u00eb vet\u00ebm, etj, thelbi i zgjidhjes nuk \u00ebsht\u00eb k\u00ebtu. \u201cThelbi \u00ebsht\u00eb zvarritja gati tridhjetvje\u00e7are e regjistrimit t\u00eb pron\u00ebs n\u00eb Shqip\u00ebri. Thelbi jan\u00eb tre dekadat e kaosit legjislativ n\u00eb fush\u00ebn e pron\u00ebsis\u00eb. Thelbi \u00ebsht\u00eb se pas 107 vjet\u00ebsh shtet shqiptar dhe 30 vjet\u00ebsh tranzicion,n\u00eb Shqip\u00ebri akoma nuk dim\u00eb kush ka \u00e7far\u00eb. K\u00ebsaj enigme 100 e kusur vje\u00e7are, do t\u00eb duhet t\u2019i jap\u00eb p\u00ebrgjigje Agjensia Shtet\u00ebrore e Kadastr\u00ebs<\/em>\u201d, u shpreh ai.<\/p>\n<p>Sipas kreut t\u00eb Agjencis\u00eb s\u00eb Legalizimeve, \u201c<em>e gjith\u00eb piramida hartografike e ngritur n\u00eb k\u00ebto tri dekada mbart brenda gjynahet e pap\u00ebrgjegjshm\u00ebris\u00eb, t\u00eb falsifikimeve, t\u00eb paaft\u00ebsis\u00eb, t\u00eb korrupsionit, t\u00eb injoranc\u00ebs, t\u00eb gjyqeve t\u00eb shitura, t\u00eb mashtrimit dhe abuzimit me pron\u00ebn. \u00a0Sipas studimit t\u00eb b\u00ebr\u00eb nga ekspertet e Bank\u00ebs Bot\u00ebrore p\u00ebr situat\u00ebn hartografike t\u00eb ZRPP, arrihet n\u00eb p\u00ebrfundimin e trisht\u00eb se 80% e pronave t\u00eb regjistruara n\u00eb Shqip\u00ebri, jan\u00eb hedhur me gabime dhe probleme hartografike<\/em>\u201d, tha Lame. Duke shtuar se shteti shqiptar, q\u00eb nga viti 1994 kur ka filluar procesi i regjistrimit t\u00eb pron\u00ebs, ka shpenzuar rreth 200 milion USD n\u00eb procesin e regjistrimit t\u00eb pronave. Por i gjith\u00eb ky lum\u00eb parash, ka sjell\u00eb pas 80 % t\u00eb pronave t\u00eb regjistruara me probleme, dhjetramij\u00ebra procese gjyq\u00ebsore, qindra t\u00eb vrar\u00eb p\u00ebr \u00e7\u00ebshtje pron\u00ebsie dhe bllokim t\u00eb mij\u00ebra aktiviteteve ekonomike.<\/p>\n<p>\u201c<em>Ligji i ri p\u00ebr Kadastr\u00ebn, nuk do sjell\u00eb lumturin\u00eb p\u00ebr nj\u00eb dit\u00eb. Na pret p\u00ebrpara nj\u00eb e p\u00ebrpjet\u00eb e jasht\u00ebzakonshme dhe nj\u00eb volum pune kolosal, por tashm\u00eb jemi t\u00eb gjith\u00eb t\u00eb nd\u00ebrgjegjsh\u00ebm se rrug\u00eb tjet\u00ebr p\u00ebr t\u00eb hedhur bazat e siguris\u00eb s\u00eb pron\u00ebs n\u00eb Shqip\u00ebri nuk ka. Para 5 vjet\u00ebsh ju premtuam shqiptar\u00ebve reform\u00ebn e legalizimit t\u00eb nd\u00ebrtimeve pa leje dhe aktualisht ky proces \u00ebsht\u00eb n\u00eb p\u00ebrmbylljen e tij. Kjo \u00ebsht\u00eb edhe garancia m\u00eb e madhe q\u00eb jep Qeveria Shqiptare, se t\u00eb nj\u00ebjtin impenjim, vullnet dhe rezultat, do t\u00eb ket\u00eb edhe n\u00eb reform\u00ebn q\u00eb sapo po nisim<\/em>\u201d, p\u00ebrfundoi Lame.<\/p>\n<p><strong>Amnistia<\/strong><\/p>\n<p>Hyrja n\u00eb fuqi e ligjit t\u00eb ri p\u00ebr krijimin e Agjencis\u00eb Shtet\u00ebrore t\u00eb Kadastr\u00ebs sjell nj\u00eb falje financiare p\u00ebr pronat e paregjistruara n\u00eb zyrat e Regjistrimit t\u00eb Pasurive t\u00eb Paluajtshme. N\u00eb ligjin e m\u00ebparsh\u00ebm parashikohej se n\u00ebse nj\u00eb k\u00ebrkes\u00eb p\u00ebr regjistrim paraqitej m\u00eb von\u00eb se 30 dit\u00eb nga data e realizimit t\u00eb tij, p\u00ebrve\u00e7 tarif\u00ebs s\u00eb regjistrimit, p\u00ebr \u00e7do dit\u00eb vones\u00eb, q\u00eb ka kaluar nga kjo dat\u00eb, paguhej kamat\u00ebvones\u00eb, e barabart\u00eb me 10 p\u00ebr qind t\u00eb tarif\u00ebs s\u00eb regjistrimit, por jo m\u00eb shum\u00eb se 300 000 lek\u00eb.<\/p>\n<p>Me ligjin e ri, parashikohet se t\u00eb gjitha kamat\u00ebvonesat e gjeneruara nga sistemi i regjistrimit t\u00eb pasurive t\u00eb paluajtshme deri n\u00eb hyrjen n\u00eb fuqi t\u00eb k\u00ebtij ligji, pra deri me 20 mars, do t\u00eb shuhen. Nga data 21 mars deri me dat\u00ebn 20 prill ata q\u00eb kan\u00eb ve\u00e7 tarif\u00ebs s\u00eb regjistrimit t\u00eb pasuris\u00eb kan\u00eb edhe kamat\u00ebvones\u00eb, do t\u00eb mund t\u00eb b\u00ebjn\u00eb regjistrimin duke paguar vet\u00ebm tarif\u00ebn e regjistrimit, pasi kamat\u00ebvonesa u falet.<\/p>\n<p>Pra. kush nuk ka b\u00ebr\u00eb n\u00eb afatin e parashikuar nga ligji regjistrimin e ndryshimit n\u00eb pron\u00ebsin\u00eb e patundshme pran\u00eb Zyrave t\u00eb Regjistrimit t\u00eb Pasuris\u00eb s\u00eb Patundshme ka shansin q\u00eb t\u00eb zeroj\u00eb k\u00ebt\u00eb detyrim. N\u00eb ligjin \u201cP\u00ebr Kadastr\u00ebn\u201d, q\u00eb \u00ebsht\u00eb miratuar n\u00eb Kuvendin e Shqip\u00ebris\u00eb, parashikohet me nen t\u00eb ve\u00e7ant\u00eb nj\u00eb amnisti p\u00ebr t\u00eb gjitha kamatvonesat, pavar\u00ebsisht nga madh\u00ebsia e tyre.<\/p>\n<p><strong>Amendimi<\/strong><br \/>\nSipas Nenit 72 \u201cP\u00ebrjashtimet dhe shuarja e kamatvonesave n\u00eb regjistrim\u201d t\u00eb ligjit t\u00eb ri, t\u00eb gjitha subjektet q\u00eb g\u00ebzojn\u00eb nj\u00eb titull pron\u00ebsie apo t\u00eb drejt\u00eb tjet\u00ebr reale t\u00eb fituar n\u00eb p\u00ebrputhje me ligjin dhe t\u00eb regjistruesh\u00ebm n\u00eb regjistrat publik\u00eb sipas nenit 193, t\u00eb Kodit Civil, dhe q\u00eb nuk kan\u00eb aplikuar p\u00ebr regjistrim pran\u00eb zyrave t\u00eb regjistrimit t\u00eb pasurive t\u00eb paluajtshme brenda afatit ligjor, rivendosen n\u00eb afat p\u00ebr aplikim, 30 dit\u00eb duke filluar nga data e hyrjes n\u00eb fuqi t\u00eb k\u00ebtij ligji.<br \/>\nPra ata do t\u00eb ken\u00eb edhe 30 dit\u00eb afat q\u00eb t\u00eb aplikojn\u00eb pa detyrime shtes\u00eb, nga dita e hyrjes n\u00eb fuqi t\u00eb k\u00ebtij ligji.<br \/>\nNga ky moment, t\u00eb gjith\u00eb kamat\u00ebvonesat q\u00eb jan\u00eb gjeneruar nga sistemi i regjistrimit t\u00eb pasurive t\u00eb paluajtshme, deri n\u00eb hyrjen n\u00eb fuqi t\u00eb k\u00ebtij ligji, p\u00ebr shkak t\u00eb mosaplikimit n\u00eb koh\u00eb p\u00ebr regjistrim t\u00eb dokumentacionit, sipas nenit 39, t\u00eb ligjit nr.33\/2012, \u201cP\u00ebr regjistrimin e pasurive te paluajtshme\u201d, t\u00eb ndryshuar, shuhen. Pra, subjektet, q\u00eb aplikojn\u00eb brenda afatit t\u00eb parashikuar n\u00eb pik\u00ebn e par\u00eb t\u00eb k\u00ebtij neni, paguajn\u00eb vet\u00ebm tarif\u00ebn aktuale p\u00ebr regjistrimin e aktit. Pra, u jepet edhe nj\u00eb afat shtes\u00eb prej nj\u00eb muaji.<\/p>\n<p><strong>Ligji aktual<\/strong><br \/>\nSipas ligjit nr. 33.2012 \u201cP\u00ebr regjistrimin e pasurive t\u00eb paluajtshme\u201d, n\u00eb fuqi, Neni 38 \u201cRegjistrimi i detyruar\u201d parashikohet q\u00eb \u00e7do akt, q\u00eb sjell ndryshime dhe ose p\u00ebrfitim t\u00eb t\u00eb drejtave t\u00eb pron\u00ebsis\u00eb, duhet t\u00eb regjistrohet. \u00c7do person, mbajt\u00ebs i titullit t\u00eb pron\u00ebsis\u00eb apo i nj\u00eb t\u00eb drejte reale n\u00ebp\u00ebrmjet nj\u00eb akti ku k\u00ebto t\u00eb drejta p\u00ebrmbahen, duhet t\u00eb paraqes\u00eb nj\u00eb k\u00ebrkes\u00eb p\u00ebr regjistrimin e aktit brenda 30 dit\u00ebve nga koha e realizimit t\u00eb tij.<br \/>\nGjykatat, noter\u00ebt, p\u00ebrmbaruesit gjyq\u00ebsor\u00eb dhe organet e tjera shtet\u00ebrore i d\u00ebrgojn\u00eb zyr\u00ebs, q\u00eb administron regjistrin ku ndodhen pasurit\u00eb e paluajtshme, kopje t\u00eb vendimit ose t\u00eb aktit q\u00eb p\u00ebrmban fitimin, njohjen, ndryshimin, pushimin e nj\u00eb t\u00eb drejte pron\u00ebsie t\u00eb paluajtshme ose t\u00eb nj\u00eb t\u00eb drejte reale mbi at\u00eb, ose q\u00eb deklarojn\u00eb t\u00eb pavlefshme veprime juridike p\u00ebr kalimin e pron\u00ebsis\u00eb t\u00eb regjistruar m\u00eb par\u00eb, brenda 30 dit\u00ebve nga data e l\u00ebshimit t\u00eb tyre.<br \/>\nM\u00eb tej, \u00ebsht\u00eb Neni 39 \u201dVonesa e paraqitjes s\u00eb dokumentacionit p\u00ebr regjistrim\u201d, q\u00eb parashikon se, n\u00ebse nj\u00eb k\u00ebrkes\u00eb p\u00ebr regjistrim, sipas nenit 38 t\u00eb k\u00ebtij ligji, paraqitet m\u00eb von\u00eb se 30 dit\u00eb nga data e realizimit t\u00eb tij, p\u00ebrve\u00e7 tarif\u00ebs s\u00eb regjistrimit, p\u00ebr \u00e7do dit\u00eb vones\u00eb, q\u00eb ka kaluar nga kjo dat\u00eb, paguhet kamat\u00ebvones\u00eb.<br \/>\nKjo kamatvones\u00eb \u00ebsht\u00eb e ndryshme p\u00ebr sh\u00ebrbime t\u00eb ndryshme, por do t\u00eb llogaritet n\u00eb vler\u00eb t\u00eb barabart\u00eb me 10 p\u00ebr qind t\u00eb tarif\u00ebs s\u00eb regjistrimit. Vet\u00ebm se kamatvonesa n\u00eb total nuk mund t\u00eb jet\u00eb m\u00eb shum\u00eb se 300.000 lek\u00eb t\u00eb reja.<\/p>\n<p><strong>Sh\u00ebrbimet q\u00eb parashikojn\u00eb kamat\u00eb<\/strong><br \/>\nHipotekat nuk i ngarkojn\u00eb me kamat\u00eb p\u00ebr vones\u00eb t\u00eb gjitha sh\u00ebrbimet q\u00eb kryhen pran\u00eb sporteleve t\u00eb tyre. Sh\u00ebrbimet q\u00eb gjobiten n\u00eb rast vonese jan\u00eb regjistrimi i kalimit t\u00eb pron\u00ebsis\u00eb me an\u00eb t\u00eb ligjit, me vendim t\u00eb gjykat\u00ebs, apo t\u00eb nj\u00eb akti administrative, pasuris\u00eb s\u00eb paluajtshme t\u00eb fituar me parashkrim fitues, regjistrimi i aktit p\u00ebr kalimin e pron\u00ebsis\u00eb nga p\u00ebrmbaruesi gjyq\u00ebsor, rejistrimi i akteve me t\u00eb cilat krijohet nj\u00eb shoq\u00ebri apo nj\u00eb subjekt tjet\u00ebr i s\u00eb drejt\u00ebs, q\u00eb ka n\u00eb pron\u00ebsi pasuri t\u00eb paluajtshme apo g\u00ebzon t\u00eb drejta t\u00eb tjera reale, etj.<br \/>\nPo k\u00ebshtu, edhe regjistrimi i kontratave t\u00eb shitjes, t\u00eb dhurimit, deklarat\u00ebs p\u00ebr heqje dor\u00eb nga pron\u00ebsia, regjistrimi i kontrat\u00ebs s\u00eb shk\u00ebmbimit, kontrat\u00ebs s\u00eb qiras\u00eb apo n\u00ebnqiras\u00eb, regjistrimi i titujve \u201cn\u00eb p\u00ebrdorim\u201d, aktit t\u00eb trash\u00ebgimis\u00eb, regjistrim \/ ndryshim \/ shuarje servituti, regjistrim i t\u00eb drejt\u00ebs s\u00eb parablerjes, etj.<br \/>\nNga ana tjet\u00ebr, gjobiten me kamatvones\u00eb edhe shkeljet n\u00eb afatin 30 ditor p\u00ebr regjistrim t\u00eb kontrat\u00ebs s\u00eb hipotek\u00ebs p\u00ebr garantimin e kredis\u00eb s\u00eb dh\u00ebn\u00eb nga banka apo institucion tjet\u00ebr kredidh\u00ebn\u00ebs, p\u00ebr kredi me vler\u00eb 1.000.000 lek\u00eb, i kontrat\u00ebs s\u00eb hipotek\u00ebs p\u00ebr garantimin e kredis\u00eb s\u00eb dh\u00ebn\u00eb nga banka apo institucion tjet\u00ebr kredidh\u00ebn\u00ebs, p\u00ebr kredi me vler\u00eb 1.000.000 \u2013 10.000.000 lek\u00eb, i kontrat\u00ebs s\u00eb hipotek\u00ebs p\u00ebr garantimin e kredis\u00eb s\u00eb dh\u00ebn\u00eb nga banka apo institucion tjet\u00ebr kredidh\u00ebn\u00ebs, p\u00ebr kredi me vler\u00eb mbi 10.000.000 lek\u00eb, regjistrim apo fshirje e kontratave t\u00eb tjera t\u00eb hipotek\u00ebs.<br \/>\nKamat\u00ebvonesa aplikohen edhe p\u00ebr raste t\u00eb regjistrim apo fshirje e hipotek\u00ebs ligjore, regjistrim i objekteve t\u00eb legalizuara, regjistrim i lejes s\u00eb nd\u00ebrtimit, regjistrim i p\u00ebrkohsh\u00ebm i karabinas\u00eb dhe regjistrimin p\u00ebrfundimtar t\u00eb nd\u00ebrtimeve t\u00eb reja<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Publikimi n\u00eb Fletoren Zyrtare i ligjit t\u00eb ri p\u00ebr Kadastr\u00ebn ka hapur rrug\u00ebn p\u00ebr p\u00ebrfundimin e procesit problematik t\u00eb njohjes s\u00eb pron\u00ebsis\u00eb n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb.
