{"id":14127,"date":"2019-07-16T09:37:09","date_gmt":"2019-07-16T07:37:09","guid":{"rendered":"http:\/\/redaktori.com\/?p=14127"},"modified":"2019-07-16T09:37:09","modified_gmt":"2019-07-16T07:37:09","slug":"ilir-meta-ka-refuzuar-serish-miratimin-e-nje-tjeter-ligji-ja-per-cfare-behet-fjale","status":"publish","type":"post","link":"https:\/\/redaktori.com\/?p=14127","title":{"rendered":"Ilir Meta ka refuzuar s\u00ebrish miratimin e nj\u00eb tjet\u00ebr ligji, ja p\u00ebr \u00e7far\u00eb b\u00ebhet fjal\u00eb"},"content":{"rendered":"<p>Vet\u00ebm nj\u00eb dit\u00eb pas kthimit t\u00eb ligjit p\u00ebr rezervat materiale t\u00eb shtetit, Presidenti Ilir Meta ka rikthyer nj\u00eb tjet\u00ebr ligj t\u00eb mazhoranc\u00ebs.<\/p>\n<div id=\"sovrn\" class=\"desktop_ad ad_bottom_space\"><\/div>\n<p>B\u00ebhet fjal\u00eb p\u00ebr ligjin\u00a0\u201cP\u00ebr privatizimin dhe dh\u00ebnien n\u00eb p\u00ebrdorim shoq\u00ebrive tregtare dhe institucioneve shtet\u00ebrore t\u00eb nd\u00ebrmarrjeve apo objekteve t\u00eb ve\u00e7anta, mjeteve kryesore dhe mjeteve t\u00eb xhiros s\u00eb k\u00ebtyre nd\u00ebrmarrjeve\u201d, t\u00eb cilin Kreu i Shtetit ka vendosur ta rikthej\u00eb n\u00eb Kuvend p\u00ebr shqyrtim.<\/p>\n<p>P\u00ebrmes nj\u00eb reagimi, Meta sqaron t\u00eb gjitha arsyet e k\u00ebtij vendimi, duke theksuar se ka disa\u00a0problematika q\u00eb ndeshen aktualisht me disa sip\u00ebrfaqe toke shtet\u00ebrore, t\u00eb cilat preken nga planet e p\u00ebrgjithshme vendore.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Sqarimi i plot\u00eb i Met\u00ebs:<\/strong><\/p>\n<p>Arsyet e kthimit t\u00eb ligjit nr. 37\/2019<br \/>\n\u201cP\u00ebr disa shtesa n\u00eb aktin normativ, me fuqin\u00eb e ligjit, nr. 4, dat\u00eb 9.7.2008, t\u00eb K\u00ebshillit t\u00eb Ministrave, \u201cP\u00ebr privatizimin dhe dh\u00ebnien n\u00eb p\u00ebrdorim shoq\u00ebrive tregtare dhe institucioneve shtet\u00ebrore t\u00eb nd\u00ebrmarrjeve apo objekteve t\u00eb ve\u00e7anta, mjeteve kryesore dhe mjeteve t\u00eb xhiros s\u00eb k\u00ebtyre nd\u00ebrmarrjeve\u201d, miratuar me ligjin nr. 9967, dat\u00eb 24.7.2008, ndryshuar me ligjin nr. 3\/2015\u201d.<\/p>\n<p>N\u00eb seanc\u00ebn plenare t\u00eb dat\u00ebs 20 qershor 2019, Kuvendi i Shqip\u00ebris\u00eb ka miratuar ligjin nr. 37\/2019 \u201cP\u00ebr disa shtesa n\u00eb aktin normativ, me fuqin\u00eb e ligjit, nr. 4, dat\u00eb 9.7.2008, t\u00eb K\u00ebshillit t\u00eb Ministrave, \u201cP\u00ebr privatizimin dhe dh\u00ebnien n\u00eb p\u00ebrdorim shoq\u00ebrive tregtare dhe institucioneve shtet\u00ebrore t\u00eb nd\u00ebrmarrjeve apo objekteve t\u00eb ve\u00e7anta, mjeteve kryesore dhe mjeteve t\u00eb xhiros s\u00eb k\u00ebtyre nd\u00ebrmarrjeve\u201d, miratuar me ligjin nr. 9967, dat\u00eb 24.7.2008, dhe ndryshuar me ligjin nr. 3\/2015\u201d.<\/p>\n<p>Ky ligj i \u00ebsht\u00eb d\u00ebrguar Presidentit t\u00eb Republik\u00ebs p\u00ebr dekretim dhe shpallje me shkres\u00ebn nr.2596 prot., dat\u00eb 26.06.2019 t\u00eb Kuvendit, administruar n\u00eb Institucionin e Presidentit t\u00eb Republik\u00ebs me nr. 2003 prot., dat\u00eb 26.06.2019.<\/p>\n<p>Sipas relacionit q\u00eb ka shoq\u00ebruar projektligjin dhe sipas p\u00ebrmbajtjes s\u00eb dispozitave t\u00eb miratuara nga Kuvendi, ky ligj ka p\u00ebr objekt dhe q\u00ebllim t\u00eb tij t\u00eb b\u00ebj\u00eb disa shtesa n\u00eb aktin normativ, me fuqin\u00eb e ligjit, nr.4, dat\u00eb 9.7.2008, t\u00eb K\u00ebshillit t\u00eb Ministrave, miratuar me ligjin nr.9967, dat\u00eb 24.7.2008, dhe ndryshuar me ligjin nr.3\/2015, n\u00eb m\u00ebnyr\u00eb q\u00eb ky akt normativ t\u00eb p\u00ebrshtatet n\u00eb funksion t\u00eb disa sip\u00ebrfaqeve toke shtet\u00ebrore q\u00eb preken nga planet e p\u00ebrgjithshme vendore.<\/p>\n<p>Kjo nis\u00ebm legjislative \u00ebsht\u00eb propozim i K\u00ebshillit t\u00eb Ministrave dhe p\u00ebr shqyrtimin e saj, kjo \u00e7\u00ebshtje \u00ebsht\u00eb ndjekur nga Komisioni i \u00c7\u00ebshtjeve Ligjore, Administrat\u00ebs Publike dhe t\u00eb Drejtat e Njeriut n\u00eb Kuvendin e Shqip\u00ebris\u00eb, n\u00eb cil\u00ebsin\u00eb e komisionit p\u00ebrgjegj\u00ebs.<br \/>\nN\u00eb relacionin shoq\u00ebrues t\u00eb K\u00ebshillit t\u00eb Ministrave nd\u00ebrmarrja e k\u00ebsaj nisme referohet se \u00ebsht\u00eb marr\u00eb shkas nga vullneti i mir\u00eb p\u00ebr t\u00eb adresuar disa problematika q\u00eb ndeshen aktualisht me disa sip\u00ebrfaqe toke shtet\u00ebrore, t\u00eb cilat preken nga planet e p\u00ebrgjithshme vendore.<\/p>\n<p>Konkretisht, sipas K\u00ebshillit t\u00eb Ministrave n\u00eb mjaft raste ekzistojn\u00eb sip\u00ebrfaqe t\u00eb ndryshme toke pron\u00eb private t\u00eb cilat jan\u00eb t\u00eb p\u00ebrfshira n\u00eb planet e miratuara t\u00eb zhvillimit urban nga ana e nj\u00ebsive t\u00eb vet\u00ebqeverisjes vendore. K\u00ebto sip\u00ebrfaqe toke private rrethojn\u00eb, prekin ose jan\u00eb menj\u00ebher\u00eb n\u00eb kufi me cop\u00ebza\/sip\u00ebrfaqe relativisht t\u00eb vogla toke n\u00eb pron\u00ebsi t\u00eb qeverisjes qendrore ose t\u00eb nj\u00ebsive t\u00eb vet\u00ebqeverisjes vendore.<\/p>\n<p>Gjithashtu, \u00ebsht\u00eb vendosur kushti q\u00eb pjesa shtet\u00ebrore q\u00eb tjet\u00ebrsohet sipas k\u00ebtij ligji t\u00eb mos jet\u00eb m\u00eb e madhe se 20 p\u00ebr qind e pron\u00ebs q\u00eb do t\u00eb zhvillohet, nd\u00ebrkoh\u00eb q\u00eb kushtet dhe kriteret q\u00eb duhet t\u00eb plot\u00ebsoj\u00eb k\u00ebrkuesi i tjet\u00ebrsimit me kontrat\u00eb t\u00eb pron\u00ebs shtet\u00ebrore, m\u00ebnyr\u00ebn e vler\u00ebsimit t\u00eb pron\u00ebs shtet\u00ebrore, si dhe organet q\u00eb p\u00ebrfshihen gjat\u00eb procesit dhe rolin e tyre do t\u00eb p\u00ebrcaktohen me vendim t\u00eb K\u00ebshillit t\u00eb Ministrave.<br \/>\nInstitucioni i Presidentit t\u00eb Republik\u00ebs vler\u00ebsoi p\u00ebrputhshm\u00ebrin\u00eb e k\u00ebtij ligji duke b\u00ebr\u00eb nj\u00eb analiz\u00eb t\u00eb kujdesshme t\u00eb p\u00ebrmbajtjes s\u00eb tij me kuadrin ligjor ekzistues n\u00eb fuqi, si dhe efekteve t\u00eb aplikimit t\u00eb k\u00ebsaj norme t\u00eb re ligjore me nivelin e mbrojtjes q\u00eb ky ofron ajo p\u00ebrkndrejt interesit publik.<\/p>\n<p>N\u00eb p\u00ebrfundim t\u00eb shqyrtimit t\u00eb ligjit nr. 37\/2019 \u201cP\u00ebr disa shtesa n\u00eb aktin normativ, me fuqin\u00eb e ligjit, nr. 4, dat\u00eb 9.7.2008, t\u00eb K\u00ebshillit t\u00eb Ministrave, Presidenti i Republik\u00ebs \u00e7mon se ky ligj, i paraqitur p\u00ebr shpallje, \u00ebsht\u00eb nj\u00eb nis\u00ebm ligjore e nxituar, jo e plot\u00eb dhe fryma e k\u00ebtij ligji shkon n\u00eb kund\u00ebrshtim me kuadrin ligjor aktual n\u00eb fuqi.<br \/>\nP\u00ebr k\u00ebto dhe t\u00eb tjera arsye t\u00eb parashtruara n\u00eb vijim, n\u00eb bindje t\u00eb Kushtetut\u00ebs s\u00eb Shqip\u00ebris\u00eb dhe n\u00eb ushtrim t\u00eb s\u00eb drejt\u00ebs t\u00eb parashikuar n\u00eb pik\u00ebn 1 t\u00eb nenit 85 t\u00eb saj, Presidenti i Republik\u00ebs ka vendosur q\u00eb ky ligj, i duhet kthyer p\u00ebr rishqyrtim Kuvendit, mb\u00ebshtetur n\u00eb argumentet e renditura si m\u00eb posht\u00eb:<br \/>\nN\u00ebp\u00ebrmjet Aktit Normativ nr. 4, dat\u00eb 9.7.2008, i cili \u00ebsht\u00eb miratuar me ligjin nr. 9967, dat\u00eb 24.7.2008, Kuvendi i Shqip\u00ebris\u00eb ka p\u00ebrcaktuar baz\u00ebn ligjore mbi t\u00eb cil\u00ebn do t\u00eb realizohen proceset e privatizimit dhe dh\u00ebnies n\u00eb p\u00ebrdorim shoq\u00ebrive tregtare dhe institucioneve shtet\u00ebrore t\u00eb nd\u00ebrmarrjeve apo objekteve t\u00eb ve\u00e7anta, mjeteve kryesore dhe mjeteve t\u00eb xhiros s\u00eb k\u00ebtyre nd\u00ebrmarrjeve.<br \/>\nPasi ky akt normativ me fuqin\u00eb e ligjit \u00ebsht\u00eb miratuar nga Kuvendi i Shqip\u00ebris\u00eb, K\u00ebshilli i Ministrave ka miratuar aktet n\u00ebnligjore t\u00eb nevojshme p\u00ebr vler\u00ebsimin e objekteve apo nd\u00ebrmarrjeve si dhe mjeteve t\u00eb tyre kryesore n\u00eb kuad\u00ebr t\u00eb procesit t\u00eb privatizimit.<br \/>\nKonkretisht q\u00ebllimi i nxjerrjes s\u00eb Aktit Normativ me fuqin\u00eb e ligjit pasqyrohet n\u00eb nenin 1 t\u00eb tij , ku paarashikohet se:<br \/>\n\u201cQ\u00ebllimi i k\u00ebtij akti normativ \u00ebsht\u00eb p\u00ebrcaktimi i organeve dhe i kompetencave, q\u00eb ato kan\u00eb, p\u00ebr privatizimin dhe dh\u00ebnien n\u00eb p\u00ebrdorim shoq\u00ebrive tregtare dhe institucioneve shtet\u00ebrore t\u00eb nd\u00ebrmarrjeve apo objekteve t\u00eb ve\u00e7anta, mjeteve kryesore dhe mjeteve t\u00eb xhiros s\u00eb k\u00ebtyre nd\u00ebrmarrjeve\u201d.<br \/>\nPra K\u00ebshilli i Ministrave dhe Kuvendi i Shqip\u00ebris\u00eb, ka qen\u00eb i qart\u00eb n\u00eb miratimin e k\u00ebtij akti ligjor, i cili pjes\u00eb t\u00eb fush\u00ebs s\u00eb rregullimit ka patur n\u00eb vijim\u00ebsi procesin e privatizimit apo dh\u00ebnies n\u00eb p\u00ebrdorim, t\u00eb ish-nd\u00ebrmarrjeve apo objekteve shtet\u00ebrore, t\u00eb cilat sipas vendimit t\u00eb organit kompetent do t\u00eb dilnin n\u00eb privatizim duke kaluar k\u00ebshtu n\u00eb pron\u00ebsi private.<br \/>\nKjo llogjik\u00eb e privatizimit t\u00eb nj\u00eb pasurie shtet\u00ebrore sipas k\u00ebtij ligji ndiqet n\u00eb gjith\u00eb nenet vijuese t\u00eb tij ku psh: n\u00eb nenin 3 dhe 4 parashikohet se kalimi i pron\u00ebs shtet\u00ebrore n\u00eb pron\u00eb private drejtohet nga ministria p\u00ebrgjegj\u00ebse p\u00ebr ekonomin\u00eb, e cila p\u00ebrcakton koh\u00ebn dhe form\u00ebn e realizimit t\u00eb privatizimit, p\u00ebr t\u00eb gjitha pasurit\u00eb shtet\u00ebrore, q\u00eb i n\u00ebnshtrohen k\u00ebtij procesi dhe ku miratimi i privatizimit p\u00ebr pasurit\u00eb e luajtshme kryhet nga organi, q\u00eb i administron ato. Organi, q\u00eb kryen procedurat e shitjes s\u00eb pron\u00ebs shtet\u00ebrore, q\u00eb privatizohet, p\u00ebrve\u00e7 rasteve kur parashikohet ndryshe me ligj, \u00ebsht\u00eb Drejtoria e Administrimit dhe Shitjes s\u00eb Pronave Publike, n\u00eb Ministrin\u00eb e Financave.<br \/>\nPra q\u00ebllimi i miratimit t\u00eb Aktit Normativ nr.4, dat\u00eb 09.07.2008, i ndryshuar, \u00ebsht\u00eb p\u00ebrcaktimi i rregullit mbi m\u00ebnyr\u00ebn se si jepet fillimisht miratimi p\u00ebr privatizimin e nj\u00eb prone shtet\u00ebrore, e m\u00eb pas m\u00ebnyra dhe procedura se si miratohet vler\u00ebsimi i nj\u00eb prone deri n\u00eb procedurat finale t\u00eb shitjes s\u00eb saj.<\/p>\n<p>N\u00eb kund\u00ebrshtim me frym\u00ebn dhe q\u00ebllimin e vet Aktit Normativ nr.4, dat\u00eb 09.07.2008, Kuvendi i Shqip\u00ebris\u00eb, me ligjin nr. 37 \/2019, ka vler\u00ebsuar t\u00eb b\u00ebj\u00eb disa shtesa n\u00eb k\u00ebt\u00eb akt ligjor. Konkretisht ligji nr. 37\/2019, p\u00ebrmban vet\u00ebm nj\u00eb nen sipas t\u00eb cilit n\u00eb aktin normativ, b\u00ebhet kjo shtes\u00eb:<br \/>\nNeni 1<br \/>\nN\u00eb nenin 2 b\u00ebhen shtesat si m\u00eb posht\u00eb:<\/p>\n<p>1.N\u00eb paragrafin e dyt\u00eb, n\u00eb fjalin\u00eb e par\u00eb, pas fjal\u00ebs \u201ctenderit\u201d shtohen fjal\u00ebt \u201cose tjet\u00ebrsimit, sipas veprimeve juridike t\u00eb kalimit t\u00eb pron\u00ebsis\u00eb s\u00eb pasurive t\u00eb paluajtshme, t\u00eb p\u00ebrcaktuara n\u00eb Kodin Civil t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, p\u00ebrve\u00e7 form\u00ebs s\u00eb kalimit t\u00eb pron\u00ebsis\u00eb n\u00ebp\u00ebrmjet kontrat\u00ebs s\u00eb dhurimit.\u201d.<\/p>\n<div id=\"pa_1x1_psbk_1563262276972\"><\/div>\n<p>2. Pas paragrafit t\u00eb dyt\u00eb shtohet nj\u00eb paragraf me k\u00ebt\u00eb p\u00ebrmbajtje:<\/p>\n<p>\u201cKalimi i pron\u00ebs shtet\u00ebrore n\u00eb private t\u00eb b\u00ebhet edhe n\u00eb funksion t\u00eb planeve t\u00eb p\u00ebrgjithshme vendore, me kushtin q\u00eb pjesa shtet\u00ebrore t\u00eb mos jet\u00eb m\u00eb e madhe se 20 p\u00ebr qind e pron\u00ebs q\u00eb do t\u00eb zhvillohet, sipas kushteve dhe kritereve q\u00eb p\u00ebrcaktohen me vendim t\u00eb K\u00ebshillit t\u00eb Ministrave. Vendimi i K\u00ebshillit t\u00eb Ministrave, p\u00ebr k\u00ebto raste, p\u00ebrcakton, gjithashtu, kushtet q\u00eb duhet t\u00eb plot\u00ebsojn\u00eb k\u00ebrkuesit e tjet\u00ebrsimit me kontrat\u00eb t\u00eb pron\u00ebs shtet\u00ebrore, m\u00ebnyr\u00ebn e vler\u00ebsimit t\u00eb pron\u00ebs shtet\u00ebrore, si dhe organet q\u00eb p\u00ebrfshihen gjat\u00eb procesit dhe rolin e tyre\u201d.<\/p>\n<p>Nga p\u00ebrmbajtja e k\u00ebsa dispozite, rezulton qart\u00eb se qeveria dhe Kuvendi, p\u00ebr t\u00eb adresuar zgjidhjen e rasteve t\u00eb ve\u00e7anta ku disa sip\u00ebrfaqe toke shtet\u00ebrore, t\u00eb cilat shtrihen p\u00ebrmes parcelave n\u00eb pron\u00ebsi private b\u00ebhen penges\u00eb p\u00ebr realizimin e investimeve, pasi nuk ekziston nj\u00eb baz\u00eb tjet\u00ebr ligjore p\u00ebr tjet\u00ebrsimin e tyre, ka nd\u00ebrmarr\u00eb k\u00ebt\u00eb iniciativ\u00eb e cila sipas Kuvendit vler\u00ebsohet si m\u00ebnyra m\u00eb e mir\u00eb p\u00ebr t\u2019i dh\u00ebn\u00eb zgjidhje me ligj k\u00ebtyre problematikave.<\/p>\n<p>Kjo problematik\u00eb pranohet n\u00eb relacionin e K\u00ebshillit t\u00eb Ministrave dhe n\u00eb raportin e Komisionit t\u00eb \u00c7\u00ebshtjeve Ligjore, Administrat\u00ebs Publike dhe t\u00eb Drejtat e Njeriut ku arsyetohet se:<br \/>\n\u201cN\u00eb mjaft raste ekzistojn\u00eb sip\u00ebrfaqe t\u00eb ndryshme toke pron\u00eb private, t\u00eb cilat jan\u00eb t\u00eb p\u00ebrfshira n\u00eb planet e miratuara t\u00eb zhvillimit urban nga ana e nj\u00ebsive t\u00eb vet\u00ebqeverisjes vendore. Por k\u00ebto sip\u00ebrfaqe toke private rrethojn\u00eb, prekin ose jan\u00eb menj\u00ebher\u00eb n\u00eb kufi me cop\u00ebza sip\u00ebrfaqeje relativisht t\u00eb vogla toke, n\u00eb pron\u00ebsi t\u00eb qeverisjes qendrore ose t\u00eb nj\u00ebsive t\u00eb vet\u00ebqeverisjes vendore.<br \/>\nPrandaj, projektligji ka p\u00ebr q\u00ebllim zgjerimin e konceptit t\u00eb privatizimit t\u00eb parashikuar n\u00eb aktin normativ, q\u00eb krahas form\u00ebs s\u00eb privatizimit me m\u00ebnyr\u00ebn e tenderit, t\u00eb parashikoj\u00eb edhe form\u00ebn e privatizimit me metod\u00ebn e \u201ctjet\u00ebrsimit\u201d n\u00eb funksion t\u00eb disa sip\u00ebrfaqeve toke shtet\u00ebrore q\u00eb preken nga planet e p\u00ebrgjithshme vendore. Nisur nga fakti se regjimi juridik i pasurive t\u00eb paluajtshme ndryshon n\u00eb funksion t\u00eb llojit apo t\u00eb m\u00ebnyr\u00ebs s\u00eb p\u00ebrdorimit t\u00eb tok\u00ebs, propozimi p\u00ebr k\u00ebt\u00eb rast \u00ebsht\u00eb q\u00eb shtesat dhe ndryshimet t\u00eb kryhen pik\u00ebrisht duke amenduar aktin normativ nr.4, t\u00eb ndryshuar, q\u00eb prek privatizimin e pronave t\u00eb institucioneve shtet\u00ebrore.<\/p>\n<p>Tjet\u00ebrsimi do t\u00eb b\u00ebhet n\u00ebp\u00ebrmjet kontratave t\u00eb tjet\u00ebrsimit ku pron\u00ebsia mbi pasurin\u00eb kalon n\u00eb \u00e7astin e lidhjes se kontrat\u00ebs s\u00eb tjet\u00ebrsimit t\u00eb k\u00ebsaj pasurie. Bler\u00ebsi apo p\u00ebrfituesi i k\u00ebsaj pasurie b\u00ebhet pronar i ligjsh\u00ebm i saj q\u00eb n\u00eb momentin e n\u00ebnshkrimit t\u00eb kontrat\u00ebs, duke fituar t\u00eb gjitha t\u00eb drejtat dhe detyrimet q\u00eb lidhen me qenien e tij si pronar mbi k\u00ebt\u00eb pasuri\u201d.<br \/>\nN\u00ebse krahasojm\u00eb drejtp\u00ebrdrejt\u00eb q\u00ebllimin p\u00ebr t\u00eb cilin \u00ebsht\u00eb nxjerr\u00eb Akti Normativ nr.4, dat\u00eb 09.07.2008 dhe p\u00ebrmbajtjen e ligjit nr.37\/2019, rezulton qart\u00eb se kemi t\u00eb b\u00ebjm\u00eb me dy akte q\u00eb synojn\u00eb t\u00eb rregullojn\u00eb \u00e7\u00ebshtje dhe problematika t\u00eb ndryshme, nd\u00ebrkoh\u00eb q\u00eb krahasimisht t\u00eb dy k\u00ebto akte nuk p\u00ebrmbajn\u00eb procedura t\u00eb s\u00eb nj\u00ebjt\u00ebs frym\u00eb q\u00eb t\u00eb garantojn\u00eb n\u00eb nivel t\u00eb nj\u00ebjt\u00eb lirin\u00eb e veprimtaris\u00eb ekonomike.<br \/>\nNisur nga ky krahasim i q\u00ebllimit t\u00eb miratimit t\u00eb k\u00ebtyre dy normave (Aktit Normativ nr.4\/2008 dhe ligjit nr. 37\/2019), Presidenti i Republik\u00ebs, arrin n\u00eb konkluzionin se nd\u00ebrhyrja q\u00eb synohet t\u00eb realizohet n\u00ebp\u00ebrmjet ligjit nr. 37\/2019, \u00ebsht\u00eb krejt\u00ebsisht e pap\u00ebrshtatshme n\u00eb m\u00ebnyr\u00ebn se si ajo \u00ebsht\u00eb realizuar.<br \/>\nRregullimi apo dh\u00ebnia zgjidhje e problematikave t\u00eb caktuara q\u00eb pengojn\u00eb zhvillimin e ekonomis\u00eb, duhet t\u00eb zgjidhet me nisma ligjore t\u00eb plota, t\u00eb qarta t\u00eb cilat ve\u00e7se t\u00eb garantojn\u00eb zgjidhjen e atyre fenomeneve q\u00eb prodhon jeta shoq\u00ebrore, duhet t\u00eb jen\u00eb patjet\u00ebr t\u00eb mb\u00ebshtetura n\u00eb parashikimet kushtetuese dhe n\u00eb harmoni me kuadrin ligjor n\u00eb fuqi q\u00eb mbron dhe garanton pron\u00ebn shtet\u00ebrore.<br \/>\nKushtetuta n\u00eb nenin 11 pika 2 t\u00eb saj parashikon se, prona private dhe publike mbrohen nj\u00eblloj me ligj. Kuvendi i Shqip\u00ebris\u00eb, n\u00eb respekt t\u00eb k\u00ebtij parashikimi kushtetues, ka miratuar ligjin nr. 8743, dat\u00eb 22.2.2001 \u201cP\u00ebr pronat e paluajtshme t\u00eb shtetit\u201d.<br \/>\nN\u00eb k\u00ebt\u00eb ligj n\u00eb nenin 2 t\u00eb tij p\u00ebrcakohet qart\u00eb se:<br \/>\na) \u201cPron\u00eb e paluajtshme e shtetit\u201d kuptohet prona e paluajtshme e pushtetit qendror dhe e nj\u00ebsive t\u00eb qeverisjes vendore.<br \/>\nb) \u201cPron\u00eb e paluajtshme publike\u201d kuptohet ajo pjes\u00eb e pronave t\u00eb paluajtshme t\u00eb shtetit q\u00eb p\u00ebrmbush funksione themelore dhe t\u00eb pandashme t\u00eb shtetit dhe q\u00eb sjell p\u00ebrfitime n\u00eb favor t\u00eb publikut t\u00eb gjer\u00eb.<br \/>\nNd\u00ebrkoh\u00eb n\u00eb nenin 3 t\u00eb k\u00ebtij ligji p\u00ebrcaktohet qart\u00eb se kush jan\u00eb ato prona t\u00eb paluajtshme q\u00eb i p\u00ebrkasin shtetit dhe b\u00ebjn\u00eb pjes\u00eb n\u00eb pronat e paluajtshme publike t\u00eb patjet\u00ebrsueshme. Nd\u00ebr parashikimet e tjera n\u00eb nenin 3, pika 4 t\u00eb ligjit nr. 8743, dat\u00eb 22.2.2001 \u201cP\u00ebr pronat e paluajtshme t\u00eb shtetit\u201d, parashikohet se:<br \/>\n\u201c4. Pronat e paluajtshme publike tjet\u00ebrsohen ose jepen n\u00eb p\u00ebrdorim sipas m\u00ebnyrave dhe kufijve t\u00eb p\u00ebrcaktuar me ligje t\u00eb ve\u00e7anta\u201d.<br \/>\nPo k\u00ebshtu p\u00ebr ti dh\u00ebn\u00eb nj\u00eb status mbrojtje t\u00eb vecant\u00eb ky ligj n\u00eb nenin 4, pika 2 parashikon se:<br \/>\n\u201cNdryshimi i statusit t\u00eb nj\u00eb prone t\u00eb paluajtshme t\u00eb shtetit nga publike n\u00eb jopublike b\u00ebhet sipas procedurave t\u00eb p\u00ebrcaktuara me ligj\u201d.<\/p>\n<p>N\u00eb referim t\u00eb k\u00ebtyre parashimimeve t\u00eb ligjit p\u00ebr mbrojtjen e pron\u00ebs shtet\u00ebrore si asaj q\u00eb konsiderohet pron\u00eb e paluajtshme e shtetit dhe asaj q\u00eb konsiderohet pron\u00eb e paluajtshme publike, rezulton se ligji nr. 37\/2019, bie n\u00eb kund\u00ebrshtim flagrant me parashikimet e ligjit nr. 8743, dat\u00eb 22.2.2001 \u201cP\u00ebr pronat e paluajtshme t\u00eb shtetit\u201d.<\/p>\n<p>Konkretisht nd\u00ebrkoh\u00eb q\u00eb ligji nr. 8743, dat\u00eb 22.2.2001 \u201cP\u00ebr pronat e paluajtshme t\u00eb shtetit\u201d, p\u00ebrcakton si t\u00eb detyrueshme q\u00eb pronat e paluajtshme publike apo pronat e paluajtshme t\u00eb shtetit tjet\u00ebrsohen ose jepen n\u00eb p\u00ebrdorim sipas m\u00ebnyrave dhe kufijve t\u00eb p\u00ebrcaktuar me ligje t\u00eb ve\u00e7anta, ligji nr. 37\/2019 n\u00eb nenin 1, pika 2 parashikon q\u00eb kalimi i pron\u00ebs shtet\u00ebrore n\u00eb private n\u00eb funksion t\u00eb planeve t\u00eb p\u00ebrgjithshme vendore, me kushtin q\u00eb pjesa shtet\u00ebrore t\u00eb mos jet\u00eb m\u00eb e madhe se 20 p\u00ebr qind e pron\u00ebs q\u00eb do t\u00eb zhvillohet, sipas kushteve dhe kritereve q\u00eb p\u00ebrcaktohen me vendim t\u00eb K\u00ebshillit t\u00eb Ministrave\u201d.<\/p>\n<p>Pra sipas parashikimeve t\u00eb nenit 1, ligji nr. 37\/2019, autorizon K\u00ebshillin e Ministrave, p\u00ebr t\u00eb p\u00ebrcaktuar kushtet q\u00eb duhet t\u00eb plot\u00ebsojn\u00eb k\u00ebrkuesit e tjet\u00ebrsimit me kontrat\u00eb t\u00eb pron\u00ebs shtet\u00ebrore.<\/p>\n<p>Pik\u00ebrisht ky delegim q\u00eb jep ligji nr. 37\/2019, tek organi i K\u00ebshillit t\u00eb Ministrave, \u00ebsht\u00eb i ndaluar sipas parashikimeve t\u00eb ligjit nr. 8743\/2001, i cili k\u00ebrkon q\u00eb pronat e paluajtshme publike apo pronat e paluajtshme t\u00eb shtetit tjet\u00ebrsohen ose jepen n\u00eb p\u00ebrdorim sipas m\u00ebnyrave dhe kufijve t\u00eb p\u00ebrcaktuar me ligj, dhe jo me vendim t\u00eb K\u00ebshillit t\u00eb Ministrave.<\/p>\n<p>Kjo situat\u00eb, krijon nj\u00eb mbivendosje t\u00eb asaj q\u00eb lejohet dhe asaj q\u00eb ndalohet midis normave rregullatore t\u00eb nivelit t\u00eb nj\u00ebjt\u00eb, pra me ligj.
